Energy Performance Certificate

An Energy Performance Certificate (EPC) is needed whenever a property is built, sold or rented. It is based on an energy survey performed by an assessor who visits the property and examines key items such as loft insulation, domestic boiler, hot water tank, radiators and windows for double glazing. They then calculate the energy efficiency. An EPC gives a property an energy efficiency rating from "A" (most efficient) to "G" (least efficient) and it is valid for 10 years.

Houses in multiple occupation

If you are the landlord of a house in multiple occupation (HMO), you must meet certain standards and obligations, including:

  • making sure your contact details are made available to the occupiers. Details must be clearly displayed in a common part of the HMO.
  • ensuring that the HMO is safe for the occupiers, especially in relation to the fire precautions, gas and electrical safety.
  • ensuring that the property is maintained in a reasonable condition, including all fixtures, furnishings and appliances.
  • ensuring that the gardens are free from waste and kept in a tidy condition.

Deposits and Fees

The law on tenant fees means that there are only specified charges that a landlord or agent cannot require the tenant, or anyone acting on the tenants behalf or guaranteeing the tenant's rent, to make in connection with a tenancy. They cannot require the tenant to enter a contract with a third party for the provision for a service or for insurance or make a loan in connection with a tenancy.

  • The rent.
  • A refundable tenancy deposit capped at no more than five weeks' rent where your total annual rent is less than £50,000, or six weeks' rent where your total annual rent is £50,000 or above.
  • A  refundable holding deposit (to reserve a property) capped at no more than one week's rent.
  • Payments to change the tenancy when requested by the tenant, capped at £50, or reasonable costs incurred if higher.
  • Payments associated with early termination of the tenancy, when requested by the tenant.
  • Payments in respect of utilities, communication services, TV licence and council tax.
  • A default fee for late payment of rent and replacement of a lost key/security device giving access to the housing, where required under a tenancy agreement.

A landlord cannot evict a tenant using the section 21 eviction procedure until they have repaid any unlawfully charged fees or returned an unlawfully retained holding deposit. All other rules around the application of the section 21 evictions procedure will continue to apply.

The landlords forum

We work with the National Landlords Association to host a forum that meets three times a year to raise and discuss issues that affect both private landlords and the council. Topics discussed include, health and safety, electrical and fire safety, financial advice and tax information. It is also a good chance to meet other landlords.
